Application
1. This Commissions Policy will apply to the purchase of the goods by the customer. We are Sophie Walsh trading as Andromeda Violet Art of 61 Rowley Hill st, St. Johns, Worcester, WR2 5LJ with email address andromedavioletart@gmail.com; the Supplier.
2. These are the terms on which we sell all goods to you. By ordering any of the goods, you agree to be bound by these policies. By ordering any of these services. You agree to be bound by these policies. You can only purchase the goods from Myself, and our website (www.andromedavioletart.com), if you are eligible to enter into a contract and are at least 18 years old.
3. In the case of any goods made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate and complete.
4. We can make changes to the goods which are necessary to comply with any applicable law or safety requirements. We will notify you of these changes.
5. A contract will be formed for the sale of goods ordered only when you receive an email from us confirming the order (order confirmation). You must ensure that the order confirmation is complete and accurate and inform us of any errors. We are not responsible for any inaccuracies in the order placed by you. By placing an order you agree to us giving you confirmation of the contract by means of an email with all information in it (ie. The order confirmation) within a reasonable time after making the contract, but in any event not later the delivery of any goods supplied under the contract.
6. Any quotation is valid for a maximum period of 7 days from its date, unless we expressly withdraw it at an earlier time. A Quotation is an approximation of costs at the time of quote and can be subject to change, and you agree to this.
7. Deposits may be required for larger Commissions as a security precaution to ourselves as a business, and you agree to this. Deposits as standard are 40% of the estimated quote, unless material costs total higher than this sum, in which an agreed price point will be made by both parties in writing. Work will not commence (contract will not be entered into) until the deposit is received (you will receive notification of this acknowledgement). Deposits will be non-refundable.
8. Material Costs are subject to an individual commission basis and will be explained upon request, regardless of this, you agree to the total cost to be added into the final price of commission.
9. Hourly rate charge is £15-40 dependant on the nature of the commission and will be explained when quoted.
10. If changes occur that affect the original quote price to be highly different to that of the final fee, and outside the means to which the consumer is willing to pay, and an agreed price point cannot be made, then the contract made be considered cancelled – see cancellation policy in Terms and Conditions, and on the website’s contact page.
11. Full price of the commission must be made, and confirmed to be received, before the goods are shipped, unless otherwise agreed by both parties in writing.
12. Late fees may be applicable to larger commissions, and you will be expressly notified of this risk before the contract is made. A 1.5% interest rate per month applies when a bill is overdue payment beyond the original 30 days period after the agreed payment date. A further charge may be added for each monthly reminder that the bill is overdue.
13. We reserve the right to refuse any commission without reason.
14. Timescale is subject to the commission and will be set out at the point of the contract being made, any further explanation or update throughout can be requested and we will do our best to respond promptly. A discount may apply if the completion of the commission is overdue by 14 days, The size of the discount is to our discretion and will be decided on a case-by-case basis and declared by the point it would need to be applied.
15. You expressly agree to any variations to the timescale and pricing that follows this policy, as long as that variation is justified and reasonable to the estimated quote given before the contract was made and an agreed price point can be settled upon. You will be notified of all changes, without undue delay.
16. No variation of the contract, whether about description of the goods, fees or otherwise, can be made after it has been entered into unless the variation is agreed by the customer and the supplier in writing.
17. We intend that these terms and conditions apply only to a contract entered into by you as a consumer. If this is not the case, you must tell us, so that we can provide you with a different contract with terms and conditions which are more appropriate for you, eg. by giving you rights as a business.
18. Delivery will be Undertaken via Royal Mail unless explicitly agreed otherwise by both parties in writing. Standard Postage Fees will apply at a 2nd Class rate unless requested otherwise, and you will be charged for any changes in relation to the update requested.
19. Risk of damage to, or loss of, any goods will pass to you when the goods are delivered to you.
20. You do not own the goods until we have received payment in full. If full payment is overdue or a step occurs towards your bankruptcy, we can choose, by notice to cancel any delivery and end any right to use the goods still owned by you, in which case you must return them or allow us to collect them.
21. Some goods may contain Glass or Allergens and the Consumer is advised to handle the product with care to avoid injury, as we will not be liable for this. If the consumer has allergies they would like to notify us of, they can do so by emailing AndromedaVioletArt@gmail.com to we can ensure no contamination is made, however, if this notification has failed to be sent in a reasonable timeframe, we cannot be held responsible for any breach in contract with said allergens. Consumer must send notification of risks present to themselves at the time of order or when a deposit is made and work commences.
22. Your privacy is critical to us. We respect your privacy and comply with the general data protection regulation with regard to your personal information.
